Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and KinSwaps LLC(“KinSwaps,” “we,” “us”). By creating an account or using KinSwaps, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.
1. Eligibility
You must be at least 18 years old and a resident of the United States to use KinSwaps. By using the platform you represent that you meet these requirements.
2. What KinSwaps Is — and Is Not
KinSwaps is a neutral venue that helps neighbors arrange informal, noncommercial, person-to-person barter of goods and services within their local rural county. KinSwaps is not a party to any trade between users.
To be explicit, KinSwaps is NOT a “barter exchange”:
- We do not operate any internal currency, credits, points, or “trade dollars,” and we assign no value to trades.
- We charge no commission or per-transaction fee on trades.
- We do not act as a ledger; we do not record balances of value owed between members. Users arrange and settle trades directly with one another.
3. Noncommercial Use Only
KinSwaps is for casual, noncommercial exchange. Using the platform to operate a business, to generate profit, as a self-employed trade, or to exchange anything for money is prohibited and may be removed. See the Acceptable Use Policy for the full list of prohibited activities and items.
4. Your Responsibility for Taxes
You are solely responsible for determining and meeting any tax obligations arising from your trades. KinSwaps does not provide tax advice, does not value your trades, and does not issue tax forms (such as Form 1099-B) for trades arranged on the platform. Consult a tax professional about your situation.
5. Trades, Meetups & Assumption of Risk
You arrange, evaluate, and complete trades at your own risk, including any decision to meet another user in person. KinSwaps does not verify users, inspect items, or guarantee the quality, safety, legality, or delivery of anything traded. You assume all risk arising from trades and in-person meetings and agree to take appropriate safety precautions.
6. Emergency & Community-Safety Features
Any weather alerts, disaster notices, emergency-kit, or responder/equipment-matching features are provided for convenience only and are not a substitute for 911 or official emergency services. Your use of these features is governed by the Emergency Features Disclaimer & Waiver, which you should read before relying on them.
7. User Content
You are responsible for the listings and content you post and retain ownership of it, granting us a license to display it to operate the service. KinSwaps is an interactive computer service that hosts content provided by its users; we are not the publisher or speaker of user-generated content. We reserve the right, but assume no obligation, to monitor, moderate, or remove content and to suspend accounts.
8. Disclaimer of Warranties
KinSwaps is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, KinSwaps and its owners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any damages arising from trades, meetups, user conduct, or the emergency features. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless KinSwaps and its owners from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the platform, your content, your trades, or your violation of these Terms.
11. Dispute Resolution; Arbitration & Class-Action Waiver
Most disputes can be resolved informally — contact us first. Any dispute that cannot be resolved will be settled by binding individual arbitration, not in court, and you and KinSwaps waive any right to a jury trial and to participate in a class action, to the extent permitted by law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
12. Termination
We may suspend or terminate your account at any time for violations of these Terms or conduct that harms the community. You may delete your account at any time from Settings.
13. Changes to These Terms
We may update these Terms. For material changes we will provide notice and may ask you to re-accept. Continued use after changes take effect constitutes acceptance.
